Cases – Listerine Total Care

Listerine Total Care is a mouthwash sold by Johnson & Johnson.  It’s active ingredient is sodium fluoride, which helps strengthen teeth and fight cavities.  However, sodium fluoride has no proven plaque-fighting capabilities. 

Johnson & Johnson advertises Listerine Total Care  provides “Total Care” and “Fights Unsightly Plaque Above the Gum Line.”  The FDA has warned Johnson & Johnson that these claims are misleading. 

On October 18, 2010, Price Waicukauski & Riley, LLC filed a class action complaint on behalf of Philippe Steele ("Plaintiff") against Johnson & Johnson on behalf of Indiana residents who bought Listerine Total Care after being exposed to Johnson & Johnson’s misleading advertising.  The Plaintiff purchased Listerine Total Care, believing it was the newest and most comprehensive Listerine product on the market.  If the Plaintiff had known that Johnson & Johnson’s claims were false, he would not have purchased Listerine Total Care.
